Present Article attempts to sketch the application of International Humanitarian Law in the context of internal armed conflict in India, as well as various approaches at national and international level to solve this problem. Since Human Rights violation is no longer contained within the stateprivate relation spectrum and has spilled outside it. Therefore, right now there is need for effective implementation machinery to check such spillage and meet new challenges posed by private actors for the enjoyment of Human Rights.
